Manish Tewari Says Way In Which (Article 370) Was Abrogated Violates Spirit Of Article 3

Congress MP Manish Tewari said that the manner in which the government scrapped the Article 370 is completely in violation of the spirit of Article 3 of the Constitution. The Article 3 of the Constitution warrants that the views of the state assembly shall be taken by the president before recommending for changing the boundary of a state. However, Tewari pointed out, "The government first made sure that the state Assembly was dissolved and the state was under Centre's control through Governor's Rule. And then you converse with yourself and decide for yourself. This is an assault on the spirit of Article 3."

With issuance of presidential Order, the NDA government has resorted to legal interpretations of the constitutional provisions to do away with Article 370, which granted special and autonomous status to Jammu and Kashmir.
